148 - A PRIEST EATING FIRST FRUITS OUTSIDE JERUSALEM


Deuteronomy 12:17 -- “You may not eat within your gates the tithe of your grain or your new wine or your oil, of the firstlings of your herd or your flock, of any of your offerings which you vow, of your freewill offerings, or of the heave offering of your hand.”
Deuteronomy 26:2-4 -- 2 “That you shall take some of the first of all the produce of the ground, which you shall bring from your land that the LORD your God is giving you, and put it in a basket and go to the place where the LORD your God chooses to make His name abide. 3 And you shall go to the one who is priest in those days, and say to him, 'I declare today to the LORD your God that I have come to the country which the LORD swore to our fathers to give us.' 4 "Then the priest shall take the basket out of your hand and set it down before the altar of the LORD your God.”

The Mishnah says: “Through the heave offering and first fruits the penalty of death by the hand of Heaven may be incurred by a zar who eats them willfully; they are subject to the additional fifth (i.e. when a zar who eats them unintentionally makes restitution); and they are forbidden to non-priests.”*

* Bik. II, 1 (Sonc. ed. p. 394). So the text of the Mishnah; the text of the “Sefer ha-Mitzvoth” mentions first the added fifth and then the penalty of death

According to the Mishnah, the owner is answerable for the first fruits until they are brought to the Temple Mount. After he has recited the chapter of the first fruits over them, they become the property of the priest.*
