The Sharia of Moses in the TORA
Part 2 - The 365 Prohibitions of the Tora

201 - POSSESSING CHAMETZ DURING PESACH

Exodus 12:9 -- “Do not eat it raw, nor boiled at all with water, but roasted in fire--its head with its legs and its entrails.”
Exodus 13:7 -- “Unleavened bread shall be eaten seven days. And no leavened bread shall be seen among you, nor shall leaven be seen among you in all your quarters.”

By this prohibition, it is forbidden for chametz* to be in possession during Passover, even if it is not seen and even if it has been deposited with a heathen.**

* See Neg. Comm. 197, p. 194, n. 2
** Mishneh Torah, Z’manim, Hilchoth Chametz u-Matzah, LV, 1- 2

The principle that chametz shall not be seen in our possession applies where it is in an open and visible place; if it is hidden, the offence is that of having it in our possession. It follows that one who offends by letting chametz be seen in his possession also offends by having it in his possession, whereas in the case of hidden chametz the latter offence is committed, but not the former.*
