224 - WHIPPING TRANSGRESSORS OF CERTAIN COMMANDMENTS


Deuteronomy 25:2 -- “Then it shall be, if the wicked man deserves to be beaten, that the judge will cause him to lie down and be beaten in his presence, according to his guilt, with a certain number of blows.”

A complete list of the commandments for the violation of which whipping is the penalty is to be found in “Mishneh Torah”.*

Scripture speaks of administering forty strokes (Deut 25: 3); the sages, however, set thirty-nine as the maximum for any one transgression. According to Maimonides, this provision was intended to keep the judges from ignoring the prohibition, Forty blows he may give him and no more, lest he should exceed this and beat him with many blows above these, and your brother be humiliated in your sight. (Deuteronomy 25:3)*
