358 - DIVORCING A WOMAN HE HAS RAPED AND BEEN COMPELLED TO MARRY


Deuteronomy 22:29 -- “Then the man who lay with her shall give to the young woman's father fifty shekels of silver, and she shall be his wife because he has humbled her; he shall not be permitted to divorce her all his days.”

With regard to the laws of seduction and rape, Maimonides writes: “As every maiden expects to be married, her seducer therefore is only ordered to marry her; for he is undoubtedly the fittest husband for her. He will better heal her wound and redeem her character than any other husband. If, however, he is rejected by her or by her father, he must give the dowry. If he uses violence he has to submit to the additional punishment, he shall not be permitted to divorce her all his days.”*
