237 - THE LAW OF INJURIES CAUSED BY AN OX


Exodus 21:28.35 -- 28 “If an ox gores a man or a woman to death, then the ox shall surely be stoned, and its flesh shall not be eaten; but the owner of the ox shall be acquitted. … 35 And if one man's ox hurts another's, so that it dies, then they shall sell the live ox and divide the money from it; and the dead ox they shall also divide.”

“In this case the law is the same for all places; but there is a difference whether the owner of the animal has been warned concerning it or not. If the animal has not been in the habit of causing damage, the owner need pay only half the damage; but if this animal has been in the habit of causing damage, and is known to be savage, damage must be paid in full.”*
