238 - THE LAW OF INJURIES CAUSED BY A PIT


Exodus 21:33-34 -- 33 "And if a man opens a pit, or if a man digs a pit and does not cover it, and an ox or a donkey falls in it, 34 the owner of the pit shall make it good; he shall give money to their owner, but the dead animal shall be his.”

If one who has opened a pit covers it adequately, he is free from liability; if he covers it inadequately, he is liable. “If he covers it and some one else uncovers it, the one who uncovers it is liable. If two partners owning a pit cover it and then one of them uncovers it, the one who uncovers it is liable. If, after they have covered it, it is uncovered, and only one of them know about it, the one who knows about it is liable and the other is free.”*
